In our ER Alerts 5/2021 and 7/2021 we advised of the introduction of the new Fair Work Act 2009 (FW Act) provisions including a new NES casual conversion clause, definition of casual employee and Casual Employment Information Statement. In response, the Fair Work Commission (FWC) commenced the Casual Terms Award Review 2021 (Review) to resolve any inconsistencies between the new FW Act provisions and existing modern award clauses.

On 24 June 2021 the Federal Government introduced the Sex Discrimination and Fair Work (Respect at Work) Amendment Bill 2021 (Respect at Work Bill) into Parliament which seeks to amend the Sex Discrimination Act 1984 (SD Act), the Fair Work Act 2009 (FW Act) and the Australian Human Rights Commission Act 1986.

Yesterday's decision of the Western Australian Industrial Relations Commission ( WAIRC) has increased the WA award rates of pay and state minimum wage by 2.5% on 1 July 2021. The wage increases will come into effect from the start of the first full pay period on or after 1 July 2021.

The decision of the Fair Work Commission (FWC) Expert Panel for annual wage reviews has increased the national minimum wage and the minimum rates of pay in modern awards by 2.5%.

Local Governments that operate in the State industrial relations system must now apply the two New Awards, which took effect on and from 27 April 2021.
