Local Government Regulations Amendment Regulations (No.2) 2020
The Department of Local Government, Sport and Cultural Industries released a Departmental Circular to advise of the above mentioned Regulations having been published in the Government Gazette on 06 November 2020. 
The Regulations introduce new measures related to:
  • Local and state-wide public notice; and
  • Improved access to information, including through publication on the Local Government’s website.
This will affect procurement activities particularly concerning advertising requirements for Tenders, Expressions of Interest and Invitations to Apply to Join Panels of Prequalified Suppliers, as well as any proposed Regional Price Preference policies, and Tenders Registers. Local Governments are encouraged to update their systems, procedures and guidelines to reflect the changes which have been brought into effect. Please refer to the Department’s Guidance Note on these amendments for further explanation of the affected Regulations.

Local Government Review Panel – Procurement Recommendations
The Minister for Local Government released the Local Government Review Panel final report, which outlines recommendations to guide the development of a new Local Government Act for Western Australia. 
The expert report provides five (5) recommendations pertaining specifically to procurement practice in Local Government. WALGA broadly supports the recommendations to align procurement practices with those of the State Government to encourage open, transparent and fair processes with adequate market testing, value for money and local consideration as key components. We encourage you to review the recommendations and welcome your feedback.

Energy Services
WALGA is currently running a Tender for its Energy contract in the categories of Sustainable Energy Infrastructure, Energy Supply and Energy Contracting.  
Contracting is anticipated in early 2021 with a range of new supplier options becoming available. Future Tenders for LED Luminaires and Energy Consulting are scheduled for February 2021.  

There has been recent demand for energy emission reporting platforms and energy consumption data analytics, following the exit of a prominent company from this area of supply. One option available to WALGA Members is the Utility Bill Management (UBM) services offered by Enel X. Through its current Tender WALGA is seeking additional technology options.

Within the Energy portfolio, the revitalisation of scoping for a whole of sector Power Purchase Agreement (PPA) and alternative future aggregate supply opportunities is also being advanced with preliminary consultancy.

A complex Tender for Telecommunications has been completed, with 33 suppliers recommended for appointment.
Contracting will progressively be undertaken through to the end of December. Under the new Preferred Supplier structure the appointments will be integrated into the ICT Services Preferred Supplier Panel.  This Tender covers 12 categories as follows:
  • Category 1 - Telecommunications Fixed Voice
  • Category 2 - Telecommunications Mobile Voice & Data
  • Category 3 - Telecommunications Data (Wide Area Network
  • Category 4 - Telecommunications Wireless Data
  • Category 5 - Telecommunications NBN Services
  • Category 6 - Telecommunications Private Fibre (Dark Fibre)
  • Category 7 - Telecommunications Satellite Services
  • Category 8 - Telecommunications Unified Communications
  • Category 9 - Telecommunications Hardware
  • Category 10 - Telecommunications Mobile Device Management
  • Category 11 - Telecommunications Video Conferencing
  • Category 12 - Telecommunications Data Centre Services

Contract Novations
Woodcutter (WA) Pty Ltd as Trustee for Woodcutter Family Trust t/as Acorn Trees & Stumps (ABN 13 675 976 873) have changed their entity and trading names to The Trustee for Yates Family Trust t/as Acorn Trees & Stumps (ABN 29 831 688 445). They are preferred suppliers on the C038_17 Parks & Gardens Goods & Services contract.

eQuotes (VendorPanel) Training
Did you know that WALGA offers free eQuotes Training?
eQuotes, WALGA’s free online request for quotation system, is an essential tool for all the staff of Members involved in purchasing goods and services through the Preferred Supplier Program (PSP).
WALGA provides free training and demonstrations for staff, as well as user support via telephone and email, in addition to the online videos and FAQs which are available in eQuotes. The training is relevant to Local Government officers who would like refresher training, or who are new to eQuotes.

Christmas and New Year Holiday Period
WALGA has received and approach from Consult Australia advocating a Blackout Tender Period for the Christmas/New Year holiday.
Under Consult Australia’s promotion of mentally healthy workplaces, the organisation has undertaken efforts across all levels of Government to ensure procurement practices are not resulting in downstream problems for mental health. Specifically Consult Australia has requested that if Tenders are released pre-Christmas that the period between Monday 21 December and Friday 8 January would not count towards the Tender open period.

In support of the above position, WALGA notes that it is a professional courtesy and good practice to either withhold the release of Tenders unless critical to business operations, and to extend the Tender Deadline for a reasonable period so that respondents do not incur stress or time imposed work related interruptions to their holiday season.

WALGA itself will be closed from Friday, 25 December, reopening Monday, 4 January 2021. We thank everyone for a memorable 2020 complete with all its challenges, and wish all Members, Suppliers and friends a joyous and relaxing holiday.
